Letter formally offering a job to accompany a contract of employment for a NEW employee

This letter can be used to make a conditional or non conditional, a temporary or a permanent offer of employment. It is most suitable for external employees, i.e. the person to whom this offer is being made does not already work for you, but it can be used for internal moves. The letter should normally accompany the employment contract. Offers can be based upon the provision of satisfactory references etc but must ALWAYS be subject to UK Border Agency rules on checking the legal right of employees to work for you BEFORE they are allowed to start work. UKBA requirements are described in the letter.

NOTE: If appointing an employee on the basis of LIST B evidence (the letter describes this in more detail) please remember to re-check the evidence of entitlement to work in the UK at 12 monthly intervals. It is only by doing so that you will have a statutory defence if one of your employees is later found to be working illegally. The statutory defence (to avoid prosecution and fines) must show that you did everything reasonably possible to avoid infringing UK laws - keeping copies of documents and periodically re-checking eligibility (at least 12 monthly for LIST B employees) will help you form your statutory defence.
