    Today, the new regulations regarding Shared Parental Leave (SPL) come into force. The new regulations give parents greater flexibility in how they share the care of their child in the first year after birth. SLP will apply to couples with babies due or children placed for adoption on or after 5 April 2015, allowing parents to choose whether they want to share the mother’s maternity leave. But what does this mean for employers? This article looks at the basics of SPL and what makes an employee eligible to request it.

    The tribunals have been full recently of holiday pay cases, starting with Williams Vs British Airways and ending with Fulton Vs Bear Scotland, with the Lock judgement expected in February. Between them the cases have determined that certain overtime pay, bonuses and commission should be included in holiday pay and led to John Lewis settling back pay for £40m. As most employers tend to pay holiday pay at the ‘normal basic rate’ the ramifications of these cases are enormous.     Yesterday saw a landmark judgement from the Employment Appeal Tribunal that will have significant implications for employers who regularly provide overtime. The press has covered the issue to varying degrees of accuracy, and we would strongly encourage employers to review their payment practices and employment contracts/staff handbooks now. This is particularly important as action taken ahead of any appeal could prevent claims being brought, and in some cases holiday pay shortfalls could cause rectification payments going back to 1998.
